End User License Agreement for Profit Forecast
Please read this End User License Agreement ("Agreement") carefully before using the Profit Forecast mobile application ("App").
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the App.
1. License Grant
Stackcommander LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal or business purposes strictly in accordance with the terms of this Agreement.
2. Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App
- Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the App
- Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of Stackcommander LLC or its affiliates, partners, suppliers or the licensors of the App
- Use the App for any illegal or unauthorized purpose
- Use the App to provide financial advice or professional services to third parties
3. Intellectual Property
The App, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of Stackcommander LLC.
3.1 Your Content
- You retain all ownership rights to the financial data, forecasts, and projections you create using the App
- All data is stored locally on your device only
- Stackcommander LLC does not claim any ownership rights to your content or financial data
- You are solely responsible for your content and the accuracy of the data you enter
4. User Data and Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy for information about how we collect and use data.
Key privacy features:
- All financial data is stored locally on your device only
- The App does not transmit your data to any servers
- No user registration or account is required
- We do not collect, store, or have access to your financial projections
5. Financial Projections and Disclaimers
IMPORTANT: THE APP PROVIDES TOOLS FOR FINANCIAL FORECASTING AND MODELING BUT DOES NOT PROVIDE FINANCIAL ADVICE.
- The App generates financial projections based solely on data you input
- All forecasts, projections, and calculations are estimates only
- Actual results may vary significantly from projections
- The App is not a substitute for professional financial advice, accounting services, or business consulting
- Stackcommander LLC does not guarantee the accuracy of any forecasts or calculations
- You should consult with qualified financial professionals before making business decisions
- The App is a planning tool only and should not be relied upon as the sole basis for financial decisions
6. Data Accuracy and User Responsibility
- You are solely responsible for the accuracy of all data you enter into the App
- You are responsible for verifying the accuracy of all forecasts and calculations
- Stackcommander LLC makes no warranties regarding the accuracy of calculations or projections
- The App's churn simulation, growth modeling, and expense calculations are mathematical models only
- Real-world results depend on numerous factors beyond the App's control
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Stackcommander LLC does not warrant that:
- The App will meet your requirements or business needs
- The App will be uninterrupted, timely, secure, or error-free
- The results or forecasts obtained from the use of the App will be accurate or reliable
- The quality of any forecasts, projections, or calculations will meet your expectations
- Any errors in the App will be corrected
- The App's calculations are suitable for tax preparation, accounting, or regulatory compliance
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STACKCOMMANDER LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the App
- Any business decisions made based on forecasts or projections generated by the App
- Any inaccuracies in calculations, projections, or forecasts
- Any reliance on the App's output for business planning or financial decisions
- Any unauthorized access to or use of our servers and/or any data stored therein
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party
- The deletion of, corruption of, or failure to store any content and other data maintained or transmitted by or through your use of the App
- Any financial losses resulting from business decisions informed by the App
9. Indemnification
You agree to indemnify, defend, and hold harmless Stackcommander LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third party right, including without limitation any copyright, property, or privacy right
- Any financial data, forecasts, or projections you create using the App
- Any business decisions made based on the App's output
10. Data Loss
- All financial data, products, revenue streams, and forecasts are stored locally on your device
- You are responsible for backing up your data
- Stackcommander LLC is not responsible for any loss of data due to device failure, app deletion, iOS updates, or any other cause
- We strongly recommend regularly backing up your device to iCloud or another backup service
- Future versions may include export functionality for additional data backup options
11. No Professional Services
The App does not provide:
- Financial advice or investment recommendations
- Accounting or tax preparation services
- Business consulting or professional services
- Legal or regulatory compliance guidance
Always consult with qualified professionals for financial, accounting, tax, or legal advice.
12. Modifications to the App
Stackcommander LLC reserves the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you.
13. Modifications to Terms
Stackcommander LLC reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms and updating the "Last Updated" date.
Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
15. Apple-Specific Terms
- These Terms are between you and Stackcommander LLC only, not with Apple Inc.
- Stackcommander LLC, not Apple, is solely responsible for the App and its content
- Apple has no obligation to provide maintenance or support services for the App
- Apple is not responsible for any product warranties
- Apple is not responsible for addressing any claims relating to the App or your possession and/or use of the App
- In the event of any third-party claim that the App infringes intellectual property rights, Stackcommander LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim
- Apple is a third-party beneficiary of these Terms and has the right to enforce these Terms against you
- You represent that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
- You represent that you are not listed on any U.S. Government list of prohibited or restricted parties

17. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Stackcommander LLC regarding the use of the App and supersede all prior agreements and understandings.
